2024年12月4日，美國國際貿(mào)易委員會（ITC）投票決定對特定TOPCon太陽能電池、組件、面板、組件和下游產(chǎn)品(II)（Certain TOPcon Solar Cells, Modules, Panels, Components Thereof, and Products Containing Same (II)）啟動337調(diào)查（調(diào)查編碼：337-TA-1425）。

2024年10月23日，美國Trina Solar (U.S.), Inc. of Fremont, California、美國Trina Solar US Manufacturing Module 1, LLC of Wilmer, Texas、中國江蘇Trina Solar Co., Ltd. of China天合光能股份有限公司向美國ITC提出337立案調(diào)查申請，主張對美出口、在美進口和在美銷售的該產(chǎn)品違反了美國337條款（侵權(quán)美國注冊專利號9,722,104、10,230,009），請求美國ITC發(fā)布有限排除令、禁止令。

中國江蘇CSI Solar Co., Ltd. of China阿特斯陽光電力集團股份有限公司、加拿大Canadian Solar Inc. of Canada、美國Canadian Solar (USA) Inc. of Walnut Creek, CA、泰國Canadian Solar Manufacturing (Thailand) Co., Ltd. of Thailand、美國Canadian Solar US Module Manufacturing Corporation of Mesquite, Texas、美國Recurrent Energy Development Holdings, LLC of Austin, TX為列名被告。

美國國際貿(mào)易委員會將于立案后45天內(nèi)確定調(diào)查結(jié)束期。除美國貿(mào)易代表基于政策原因否決的情況外，美國國際貿(mào)易委員會在337案件中發(fā)布的救濟令自發(fā)布之日生效并于發(fā)布之日后的第60日起具有終局效力。
